MADDE 1: TARAFLAR<\/strong><\/p>\n\n\n\n

Bir tarafta adresi Hobyar Mah. A\u015firefendi Cad. \u0130mar Han Blok No:15\/4 Fatih\/\u0130stanbul olan Ays Otelcilik Turizm \u0130n\u015faat Emlak Sanayi ve Ticaret Anonim \u015eirketi (VKN: 1230486001)  (\u0130\u015fbu s\u00f6zle\u015fmede k\u0131saca \u201cOTEL\u201d olarak an\u0131lacakt\u0131r.)<\/em><\/strong> ile di\u011fer tarafta M\u0130SAF\u0130R(ler) aras\u0131nda rezervasyon ve konaklama hizmetine ili\u015fkin olarak a\u015fa\u011f\u0131daki \u015fartlar \u00e7er\u00e7evesinde Mesafeli Hizmet S\u00f6zle\u015fmesi d\u00fczenlenmi\u015ftir. Misafir rezervasyon i\u015flemini yaparak i\u015fbu Mesafeli Hizmet S\u00f6zle\u015fme\u2019sini okudu\u011funu ve kabul etti\u011fini beyan eder.<\/p>\n\n\n\n

MADDE 2: S\u00d6ZLE\u015eMEN\u0130N KONUSU<\/strong><\/p>\n\n\n\n

2.1.<\/strong> \u0130\u015fbu s\u00f6zle\u015fmenin konusu; M\u0130SAF\u0130R’nin, OTEL taraf\u0131ndan \u201chttps:\/\/orientoccidenthotel.com\/\u201d websitesi (\u201cWebsite\u201d)<\/strong> \u00fczerinden sunulan konaklama hizmetinden yararlanmas\u0131na ili\u015fkin rezervasyon, \u00f6deme, iptal-iade, konaklama kurallar\u0131 ve di\u011fer ko\u015fullar\u0131n belirlenmesi ile 6502 Say\u0131l\u0131 T\u00fcketicinin Korunmas\u0131 Hakk\u0131nda Kanun ve Mesafeli S\u00f6zle\u015fmeler Y\u00f6netmeli\u011fi h\u00fck\u00fcmleri gere\u011fince, taraflar\u0131n kar\u015f\u0131l\u0131kl\u0131 hak ve y\u00fck\u00fcml\u00fcl\u00fcklerini kapsamaktad\u0131r.<\/p>\n\n\n\n

2.2.<\/strong> \u0130\u015fbu s\u00f6zle\u015fme M\u0130SAF\u0130R\u2019in, OTEL vas\u0131tas\u0131 ile a\u015fa\u011f\u0131da a\u00e7\u0131klanan ko\u015fullar \u00e7er\u00e7evesinde hizmet al\u0131m\u0131 \u00e7er\u00e7evesindeki otel rezervasyonunu i\u00e7ermekte olup Taraflar\u2019\u0131n kar\u015f\u0131l\u0131kl\u0131 hak ve y\u00fck\u00fcml\u00fcl\u00fcklerinin d\u00fczenlenmesinden ibarettir.<\/p>\n\n\n\n

2.3.<\/strong> M\u0130SAF\u0130R, OTEL taraf\u0131ndan belirlenen konaklama kurallar\u0131, rezervasyon kurallar\u0131 ve tarifeleri hakk\u0131nda bilgilendirildi\u011fini ve bunlara riayet edece\u011fini kabul ve beyan eder.<\/p>\n\n\n\n

2.4.<\/strong>  \u0130\u015fbu S\u00f6zle\u015fme M\u0130SAF\u0130R taraf\u0131ndan hizmetin sat\u0131n al\u0131nd\u0131\u011f\u0131 tarihte y\u00fcr\u00fcrl\u00fc\u011fe girecek olup, hizmet s\u00fcresinin bitimiyle birlikte herhangi bir bildirime l\u00fczum olmaks\u0131z\u0131n kendili\u011finden sona erecektir.<\/p>\n\n\n\n

MADDE 3 – H\u0130ZMET\u0130N TANIMI VE \u015eARTLARI<\/strong><\/p>\n\n\n\n

3.1.<\/strong> Konaklama \u00fccretine dahil olan t\u00fcm hizmetler Websitesi\u2019nde ayr\u0131nt\u0131l\u0131 olarak belirtilmi\u015f olup, bunlar\u0131n d\u0131\u015f\u0131ndaki hizmetler ekstra \u00fccrete tabidir. \u00d6zellikle, sat\u0131n al\u0131nan hizmete; M\u0130SAF\u0130R\u2019in konaklamaya dahil hizmetler d\u0131\u015f\u0131nda alaca\u011f\u0131 ekstra yiyecek\/i\u00e7ecek, ki\u015fisel harcamalar, ula\u015f\u0131m ve kapsam d\u0131\u015f\u0131 t\u00fcm mal ve hizmetlerin bedeli dahil de\u011fildir. M\u0130SAF\u0130R taraf\u0131ndan ekstra yap\u0131lan harcamalar, otelden \u00e7\u0131k\u0131\u015f s\u0131ras\u0131nda \u00f6denecektir.<\/p>\n\n\n\n

3.2.<\/strong> Rezervasyon ile ilgili bilgiler, M\u0130SAF\u0130R\u2019in bildirmi\u015f oldu\u011fu e-posta hesab\u0131na g\u00f6nderilecektir. M\u0130SAF\u0130R, OTEL\u2019e giri\u015fte ge\u00e7erli kimlik belgesi ibraz etmekle y\u00fck\u00fcml\u00fcd\u00fcr. Kimlik bilgileri ile rezervasyon bilgileri uyu\u015fmad\u0131\u011f\u0131 takdirde OTEL\u2019in, konaklama hizmeti sa\u011flama y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bulunmamaktad\u0131r. M\u0130SAF\u0130R taraf\u0131ndan rezervasyon s\u0131ras\u0131nda, yanl\u0131\u015f veya eksik beyan halindeki bildirimler nedeniyle hizmet bedelinde bir fark do\u011far ise, i\u015fbu bedel fark\u0131 otele giri\u015f esnas\u0131nda M\u0130SAF\u0130R\u2019den tahsil edilir.<\/p>\n\n\n\n

3.3.<\/strong> M\u0130SAF\u0130R, kendisiyle birlikte konaklayacak di\u011fer ki\u015filerin de bilgilerini do\u011fru beyan etti\u011fini ve bu ki\u015filerin bilgilerini OTEL ile payla\u015fmaya onaylar\u0131n\u0131n oldu\u011funu kabul eder.<\/p>\n\n\n\n

3.4.<\/strong> M\u0130SAF\u0130R, otel kurallar\u0131na ve tesis i\u00e7i d\u00fczenlemelere uymay\u0131 kabul eder. Di\u011fer misafirlerin huzurunu bozacak davran\u0131\u015flarda bulunmas\u0131 halinde, konaklama hizmetinin sonland\u0131rabilece\u011fini ve \u00fccret iadesi yap\u0131lmayaca\u011f\u0131n\u0131 kabul eder.<\/p>\n\n\n\n

3.5.<\/strong> M\u0130SAF\u0130R; hukuka ayk\u0131r\u0131 olarak ger\u00e7ekle\u015ftirdi\u011fi eylemlerin OTEL taraf\u0131ndan tespiti halinde, OTEL taraf\u0131ndan i\u015fbu s\u00f6zle\u015fmenin hakl\u0131 nedenle feshedilece\u011fini ve kendisine hizmet verilmeyece\u011fini ve taraf\u0131na \u00fccret iadesi yap\u0131lmayaca\u011f\u0131n\u0131 kabul ve beyan eder.<\/p>\n\n\n\n

3.6.<\/strong> Otel odalar\u0131nda ve ortak alanlarda demirba\u015flara zarar verilmesi halinde zarar\u0131n tazmini M\u0130SAF\u0130R\u2019ye aittir.<\/p>\n\n\n\n

3.7.<\/strong> M\u0130SAF\u0130R kendisine ait bagaj\/bagaj\u0131n i\u00e7eri\u011fi ve de\u011ferli e\u015fyalar ile ilgili her t\u00fcrl\u00fc sorumlulu\u011fun m\u00fcnferiden kendisine ait oldu\u011funu; yan\u0131nda bulunan t\u00fcm e\u015fyay\u0131 takip ve kontrol etmekle y\u00fck\u00fcml\u00fc oldu\u011funu, kaybolan, h\u0131rs\u0131zl\u0131k konusu olan, zayi olan e\u015fyas\u0131ndan, k\u0131ymetli e\u015fyas\u0131ndan OTEL\u2019in ve \u00e7al\u0131\u015fanlar\u0131n\u0131n hukuki ve\/veya cezai hi\u00e7bir sorumlulu\u011funun bulunmad\u0131\u011f\u0131n\u0131, bu sebeple OTEL\u2019e ve Otel \u00e7al\u0131\u015fanlar\u0131na kar\u015f\u0131 hi\u00e7bir talepte bulunmayaca\u011f\u0131n\u0131 kabul ve taahh\u00fct eder.<\/p>\n\n\n\n

3.8.<\/strong> Otele giri\u015f (check-in) saati _:_\u2019dir. \u0130\u015fbu saatten \u00f6nce M\u0130SAF\u0130R taraf\u0131ndan otele var\u0131lmas\u0131 halinde dahi oda teslimi yap\u0131lmamaktad\u0131r. Otelden \u00e7\u0131k\u0131\u015f (check-out) saati _:_\u2019dir. M\u0130SAF\u0130R\u2019nin saat _:_\u2019dan sonra oday\u0131 teslim etmesi halinde, oda ba\u015f\u0131na bir gecelik oda \u00fccretine e\u015fde\u011fer bedelde ek \u00f6deme, otelden ayr\u0131l\u0131\u015f s\u0131ras\u0131nda tahsil edilecektir.<\/p>\n\n\n\n

3.9.<\/strong> M\u0130SAF\u0130R\u2019in rezervasyon yapm\u0131\u015f oldu\u011fu kart check-in s\u0131ras\u0131nda ibraz\u0131 gerekebilecek olup, ibraz edilmemesi halinde M\u0130SAF\u0130R\u2019in o kart\u0131 ile yapm\u0131\u015f oldu\u011fu \u00f6deme iptal edilip, yeni bir kartla \u00f6demesi talep edilebilecektir.<\/p>\n\n\n\n

MADDE 4 – REZERVASYON VE \u00d6DEME<\/strong><\/p>\n\n\n\n

4.1.<\/strong> M\u0130SAF\u0130R, S\u00f6zle\u015fme bedelini, kredi kart\u0131\/banka kart\u0131 ile OTEL\u2019e ait \u201chttps:\/\/orientoccidenthotel.com\/\u201d websitesi \u00fczerinden \u00f6deyecektir.<\/p>\n\n\n\n

4.2.<\/strong> M\u0130SAF\u0130R, kampanyal\u0131 veya indirimli rezervasyonlarda hizmet bedelinin tamam\u0131n\u0131 rezervasyon esnas\u0131nda \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n\n\n\n

4.3.<\/strong> Otel taraf\u0131ndan d\u00fczenlenen fatura, M\u0130SAF\u0130R\u2019e konaklama sonras\u0131 \u00e7\u0131k\u0131\u015f tarihinde teslim edilecek veya elektronik ortamda iletilecektir.<\/p>\n\n\n\n

MADDE 5 – \u0130PTAL VE \u0130ADE KO\u015eULLARI<\/strong><\/p>\n\n\n\n

5.1.<\/strong> M\u0130SAF\u0130R, rezervasyon iptali talebini yaz\u0131l\u0131 olarak \u201cinfo@orientoccidenthotel.com\u201d e-posta adresi \u00fczerinden veya \u201c+90 212 252 10 10\u201d numaral\u0131 telefon arac\u0131l\u0131\u011f\u0131yla OTEL\u2019e bildirmekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n\n\n\n

5.2.<\/strong> Yap\u0131lmas\u0131 gereken iadelerde, rezervasyon i\u00e7in kullan\u0131lan kredi kart\u0131na veya M\u0130SAF\u0130R\u2019nin banka hesab\u0131na 30 g\u00fcn i\u00e7erisinde \u00f6deme yap\u0131l\u0131r.<\/p>\n\n\n\n

6.  \u0130PTAL KO\u015eULLARI<\/strong><\/p>\n\n\n\n

6.1.<\/strong> \u0130ade edilmez (Non-Refundable) rezervasyonlarda iptal-no show halinde M\u0130SAF\u0130R\u2019in yapm\u0131\u015f oldu\u011fu \u00f6deme iade edilmez. M\u0130SAF\u0130R bunu bilerek rezervasyon ve \u00f6deme yapm\u0131\u015f oldu\u011funu kabul ve beyan eder. M\u0130SAF\u0130R\u2019in konaklama yapmam\u0131\u015f olmas\u0131 halinde t\u00fcm bedel M\u0130SAF\u0130R\u2019den \u00e7ekilir.<\/p>\n\n\n\n

6.2.<\/strong> \u0130ade edilir (Refundable) rezervasyonlarda check-in g\u00fcn\u00fcne _____ saat kala yap\u0131lan rezervasyonlarda iade m\u00fcmk\u00fcnd\u00fcr.<\/p>\n\n\n\n

6.3.<\/strong> M\u0130SAF\u0130R taraf\u0131ndan rezervasyon iptal edilmeksizin gelinmemesi halinde OTEL taraf\u0131ndan hizmet bedelinin iadesi yap\u0131lmayacakt\u0131r.<\/p>\n\n\n\n

MADDE 7 – K\u0130\u015e\u0130SEL VER\u0130LER VE G\u0130ZL\u0130L\u0130K<\/strong><\/p>\n\n\n\n

7.1.<\/strong> M\u0130SAF\u0130R, ki\u015fisel verilerinin 6698 say\u0131l\u0131 Ki\u015fisel Verilein Korunmas\u0131 Kanunu  kapsam\u0131nda, rezervasyon ve konaklama amac\u0131yla i\u015flenmesini ve i\u015fbu ama\u00e7lar ile OTEL\u2019in i\u015f ortaklar\u0131yla payla\u015f\u0131lmas\u0131n\u0131 kabul eder.<\/p>\n\n\n\n

7.2.<\/strong> M\u0130SAF\u0130Rlere ait ki\u015fisel veriler, yaln\u0131zca hizmetin gerektirdi\u011fi \u00f6l\u00e7\u00fcde kullan\u0131lacakt\u0131r.<\/p>\n\n\n\n

MADDE 8 – M\u00dcCB\u0130R SEBEPLER<\/strong><\/p>\n\n\n\n

8.1. <\/strong>Do\u011fal afet, sava\u015f, ter\u00f6r, salg\u0131n hastal\u0131k, teknik ar\u0131za, kamu otoritesinin karar\u0131 gibi m\u00fccbir sebepler nedeniyle OTEL\u2019in hizmet verememesi durumunda OTEL\u2019in sorumlulu\u011fu do\u011fmaz. M\u00fccbir sebeplerin varl\u0131\u011f\u0131 nedeniyle OTEL taraf\u0131ndan hizmet verilememesi halinde, M\u0130SAF\u0130R i\u015fbu sebeple OTEL\u2019den hi\u00e7bir talepte bulunamayaca\u011f\u0131n\u0131 kabul eder.<\/p>\n\n\n\n

8.2. <\/strong>M\u0130SAF\u0130R\u2019nin; m\u00fccbir sebep (\u00f6l\u00fcm, deprem vb.) durumlar\u0131 resmi belge ile kan\u0131tlanmak \u015fart\u0131yla OTEL taraf\u0131ndan de\u011ferlendirmeye al\u0131nacak olup, OTEL taraf\u0131ndan kabul edilmesi halinde kal\u0131nmayan s\u00fcrelerin hizmet bedeli M\u0130SAF\u0130R\u2019ye iade edilecektir. M\u00fccbir sebepler haricinde,  M\u0130SAF\u0130R taraf\u0131ndan otele ge\u00e7 giri\u015f yap\u0131lmas\u0131 ya da otelden erken \u00e7\u0131k\u0131\u015f yap\u0131lmas\u0131 halinde kalan s\u00fcrelerin bedelleri iade edilmeyecektir.<\/p>\n\n\n\n

MADDE 9- YETK\u0130L\u0130 MAHKEME<\/strong><\/p>\n\n\n\n

\u0130\u015fbu konaklama s\u00f6zle\u015fmesinin uygulanmas\u0131ndan do\u011fan ihtilaflar\u0131n \u00e7\u00f6z\u00fcm\u00fcnde; \u00f6ncelikle i\u015fbu s\u00f6zle\u015fme h\u00fck\u00fcmleri ile 6502 say\u0131l\u0131 T\u00fcketicinin Korunmas\u0131 Hakk\u0131nda Kanun ve ilgili Y\u00f6netmelik h\u00fck\u00fcmleri uygulanacak olup, taraflar, yasal s\u0131n\u0131rlar i\u00e7inde T\u00fcketici Mahkemelerine ve\/veya T\u00fcketici Sorunlar\u0131 Hakem Heyetine ba\u015fvurabilirler. Uyu\u015fmazl\u0131klar\u0131n \u00e7\u00f6z\u00fcm\u00fcnde yetkili mahkeme; \u0130stanbul (\u00c7a\u011flayan) mahkeme ve icra daireleridir.<\/p>\n\n\n\n

ARTICLE 1: PARTIES<\/strong><\/p>\n\n\n\n


This Distance Service Agreement is made between Ays Otelcilik Turizm \u0130n\u015faat Emlak Sanayi ve Ticaret Anonim \u015eirketi (Tax No: 1230486001), located at \u201cHobyar Mah. A\u015firefendi Cad. \u0130mar Han Blok No:15\/4 Fatih\/Istanbul\u201d (hereinafter referred to as the “HOTEL”), and the GUEST(S), under the terms and conditions outlined below regarding reservation and accommodation services. By completing a reservation, the GUEST acknowledges having read, understood, and accepted all provisions of this Agreement.<\/p>\n\n\n\n

ARTICLE 2: SUBJECT OF THE AGREEMENT<\/strong><\/p>\n\n\n\n


2.1.<\/strong> The purpose of this Agreement is to determine the terms and conditions of the reservation, payment, cancellation-refund, accommodation rules, and other relevant provisions regarding the accommodation services offered by the HOTEL through its website \u201chttps:\/\/ orientoccidenthotel.com\/\u201d, in accordance with the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.<\/p>\n\n\n\n


2.2.<\/strong> This Agreement regulates the mutual rights and obligations of the PARTIES in connection with the hotel reservation made by the GUEST through the HOTEL under   the specified terms.<\/p>\n\n\n\n


2.3<\/strong>. The GUEST acknowledges and declares that they have been informed of and will comply with the accommodation rules, reservation policies, and rates determined by the HOTEL.<\/p>\n\n\n\n


2.4.<\/strong> This Agreement enters into force on the date the service is purchased by the GUEST and automatically terminates at the end of the service period without the need for further notice.<\/p>\n\n\n\n

ARTICLE 3: DESCRIPTION AND TERMS OF SERVICE<\/strong><\/p>\n\n\n\n


3.1.<\/strong> Services included in the accommodation fee are specified in detail on the Website. All other services are subject to additional charges. Specifically, the purchased service does not include extra food\/beverages, personal expenses, transportation, and any goods or services outside the accommodation package. Any extra expenses incurred by the GUEST must be paid upon check-out.<\/p>\n\n\n\n


3.2.<\/strong> Reservation information will be sent to the email address provided by the GUEST. The GUEST is required to present valid identification at check-in. If the identification information does not match the reservation, the HOTEL is not obliged to provide the accommodation service. If incorrect or incomplete information results in a fee difference, this amount will be collected from the GUEST at check-in.<\/p>\n\n\n\n


3.3.<\/strong> The GUEST declares that the information provided for accompanying guests is accurate and that they have obtained consent to share such information with the HOTEL.<\/p>\n\n\n\n


3.4.<\/strong> The GUEST agrees to comply with hotel rules and in-house regulations. If behavior disturbing other guests is exhibited, the accommodation service may be terminated without any refund.<\/p>\n\n\n\n


3.5.<\/strong> If the HOTEL determines that the GUEST has committed unlawful acts, the HOTEL reserves the right to terminate this Agreement with just cause, deny service, and retain any paid fees.<\/p>\n\n\n\n


3.6.<\/strong> In the event of damage to hotel property or furnishings in rooms or common areas, the GUEST shall be liable for the cost of repairs.<\/p>\n\n\n\n


3.7.<\/strong> The GUEST accepts full personal responsibility for their luggage, belongings, and valuables. The HOTEL and its staff bear no legal or criminal liability for loss, theft, or damage, and the GUEST agrees not to make any claims.<\/p>\n\n\n\n


3.8.<\/strong> Hotel check-in time is _:<\/strong>_ Rooms will not be delivered before this time even if the GUEST arrives early. Check-out time is _:_<\/strong>. If the room is vacated after _:<\/strong>_, an additional charge equal to one night\u2019s stay will be collected at check-out.<\/p>\n\n\n\n


3.9.<\/strong> The credit card used for the reservation may be required at check-in. If not presented, the payment made with the card may be cancelled and a new payment with another card may be requested.<\/p>\n\n\n\n

ARTICLE 4: RESERVATION AND PAYMENT<\/strong><\/p>\n\n\n\n


4.1.<\/strong> The GUEST shall make the payment via credit card\/debit card through the HOTEL\u2019s website \u201chttps:\/\/orientoccidenthotel.com\/\u201d.<\/p>\n\n\n\n


4.2.<\/strong> For discounted or promotional reservations, the full service fee must be paid at the time of booking.<\/p>\n\n\n\n


4.3.<\/strong> An invoice will be issued by the HOTEL and delivered to the GUEST upon check-out or sent electronically.<\/p>\n\n\n\n

ARTICLE 5: CANCELLATION AND REFUND CONDITIONS<\/strong><\/p>\n\n\n\n


5.1.<\/strong> The GUEST must notify the HOTEL of a cancellation request in writing via email to \u201cinfo@orientoccidenthotel.com\u201d or by calling \u201c+90 212 252 10 10\u201d.<\/p>\n\n\n\n


5.2.<\/strong> Refunds, if applicable, will be processed to the credit card or bank account used for the reservation within 30 days.<\/p>\n\n\n\n

ARTICLE 6: CANCELLATION POLICIES<\/strong><\/p>\n\n\n\n


6.1.<\/strong> For Non-Refundable<\/strong> reservations, no refunds will be made in the event of cancellation or no-show. The GUEST acknowledges this condition when making the reservation and payment. If the GUEST does not stay at the hotel, the full fee will still be charged.<\/p>\n\n\n\n


6.2.<\/strong> For Refundable<\/strong> reservations, cancellations made at least ___ hours before check-in are eligible for a refund.<\/p>\n\n\n\n


6.3<\/strong>. In case of no-show without cancellation, no refund will be issued by the HOTEL.<\/p>\n\n\n\n

ARTICLE 7: PERSONAL DATA AND PRIVACY<\/strong><\/p>\n\n\n\n


7.1<\/strong>. The GUEST agrees that their personal data may be processed and shared with the HOTEL\u2019s business partners for the purposes of reservation and accommodation in accordance with the Law on the Protection of Personal Data No. 6698.<\/p>\n\n\n\n


7.2.<\/strong> Personal data of guests will be used only to the extent required to provide the service.<\/p>\n\n\n\n

ARTICLE 8: FORCE MAJEURE<\/strong><\/p>\n\n\n\n


8.1.<\/strong> The HOTEL is not liable if unable to provide services due to force majeure events such as natural disasters, war, terrorism, pandemics, technical failures, or decisions of public authorities. The GUEST acknowledges that they shall not make any claims against the HOTEL in such circumstances.<\/p>\n\n\n\n


8.2.<\/strong> If the GUEST is unable to arrive due to a force majeure event (e.g., death, earthquake), and provides official documentation, the HOTEL will evaluate the situation.
